These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Column8 LLC ("Company," "we," "us," or "our") governing your access to and use of the Zuppy mobile application ("App"), the Zuppy website at https://www.zuppyhealth.com ("Website"), and any related services (collectively, the "Services").
By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
Zuppy is a nutrition and meal-tracking mobile application that helps users:
The Services are available on iOS (via the App Store) and Android (via the Google Play Store).
You must be at least 13 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Services. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Services and that they have agreed to these Terms on your behalf.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or suspected breach of security.
You may terminate your account at any time through the in-app account deletion feature or by contacting us. Upon termination, we will delete your account data in accordance with our data retention practices and applicable law.
We may suspend or terminate your account and access to the Services at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Zuppy offers a free tier with limited features and a premium subscription ("Zuppy Pro") that provides additional features, including unlimited meal analysis and other premium functionality.
Subscription payments are processed entirely through the Apple App Store or Google Play Store. Column8 LLC does not collect or store your payment details. By subscribing, you agree to the payment terms of the applicable platform. All fees are charged in advance and are non-refundable except as required by applicable law or as expressly stated in the platform's refund policy.
Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan. You can view and manage your subscription and turn off auto-renewal at any time by going to your account settings in the App Store or Google Play Store after purchase. Cancellation takes effect at the end of the current paid period — you will retain access until then.
We may offer a free trial of Zuppy Pro. If you begin a free trial, you will not be charged during the trial period. Your subscription will automatically begin and your payment method will be charged at the end of the trial period unless you cancel at least 24 hours before the trial ends. You may only use a free trial once per Apple ID or Google account.
Because subscriptions are billed through Apple or Google, all refund requests must be made directly to the applicable platform:
We do not issue refunds directly. If you believe you were charged in error, please contact us and we will assist in resolving the issue with the platform.
We may change subscription prices. For existing subscribers, price changes will apply at the start of the next renewal period, and we will provide advance notice as required by applicable platform policies and law. Continuing to use the service after a price change takes effect constitutes acceptance of the new price.
If you reinstall the App or switch devices, you may restore your active subscription through the in-app "Restore Purchases" feature using the same Apple ID or Google account used to purchase.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

The nutrition information, calorie estimates, and recommendations provided by the App are approximations and may not be accurate for your individual circumstances. Always consult a qualified healthcare provider, nutritionist, or dietitian before making significant changes to your diet or health regimen.
The Services, including all content, features, design, text, graphics, logos, and software, are owned by Column8 LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works of the Services without our prior written consent.
Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy at https://www.zuppyhealth.com/en/privacy. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Column8 LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Website or through the App, and by updating the "Last updated" date above. Your continued use of the Services after effective date of changes constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising in connection with these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Column8 LLC regarding the Services and supersede any prior agreements.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
